I want to apply for family reunification for my wife to bring her to Zagreb. She got deported from Norway on 02.03.2023 also banned from Schengen Information System. She got visas from Bulgaria(2024) and Romania(2023) (not Schengen) also travelled there and back after the deportation. We both non EU citizen. I am working in Zagreb, Croatia with blue card (valid until 22.12.2026). I want to remove the SIS ban from the system so we can apply for family reunification. I need information what to do and assistance of a lawyer with experience who can remove the ban.

Thank you for your detailed explanation. Here's a structured legal response regarding the removal of a Schengen Information System (SIS) entry and the family reunification process in Croatia.

Key Facts Recap:
Your wife was deported from Norway on 02.03.2023.

She was also entered into SIS with a ban (likely SIS II alert – Article 24 of the Schengen Borders Code).

She travelled to Bulgaria and Romania, which are EU countries but not yet fully in the Schengen Area.

You are a non-EU citizen, currently in Croatia with a valid Blue Card until 22.12.2026.

You want to apply for family reunification and need the SIS ban removed.

1. Understanding the SIS Ban
A Schengen ban in SIS (typically Article 24 SIS II Regulation) means:

Your wife is prohibited from entering or staying in the entire Schengen Area.

Croatia is part of the Schengen Area since 2023, so she cannot enter unless the alert is removed or the competent authority waives it.

2. Steps to Remove SIS Entry (Ban)
A. Identify the Authority That Issued the Ban
Since the deportation was from Norway, the Norwegian Police Immigration Service (PU) is likely the issuer. The SIS alert includes:

Entry prohibition (standard is 1 to 5 years),

Personal data,

Reason for ban.

You must appeal or request deletion directly to Norway.

B. Submit a Formal Request for Deletion or Shortening of Ban
Your wife can file:

Administrative appeal or request for deletion based on family reunification (humanitarian grounds under Article 25 of the Schengen Convention).

Show:

She is married to a legal resident in Croatia (you).

Her presence is necessary for family unity, per European Court of Human Rights (Article 8 ECHR).

Her reintegration poses no security threat.

Her travel to Bulgaria and Romania shows she complied with other EU regulations.

Recommended document to submit:

Marriage certificate (translated & notarized),

Your Blue Card and employment contract in Croatia,

Lease contract or proof of accommodation in Croatia,

Letters of support or legal opinion from Croatian authorities (if available).

3. Legal Basis for Deletion: Article 25 SIS II Regulation
"Before issuing an alert for refusal of entry or stay, consideration shall be given to whether the refusal is proportionate in relation to the purpose of the alert, particularly when the person concerned is a family member of an EU citizen or a legal resident."

Croatia, as a new Schengen member, will check SIS when you file for reunification. If your wife is still in the system, the Ministry of Interior will refuse the application unless the ban is lifted or waived.

4. Assistance from a Lawyer
You will need:

A Norwegian immigration lawyer to file the deletion request.

Optionally, a Croatian immigration lawyer to:

Guide you in family reunification procedures,

Help with letters of support or formal request to Croatian MUP (Ministry of Interior) to invoke Article 25 and override the ban for humanitarian grounds.

5. Next Steps
Contact a lawyer in Norway (I can help locate one).

Prepare a deletion request citing:

Article 25 SIS II,

ECHR Article 8 (Right to family life),

Humanitarian/compassionate grounds.

Wait for Norway’s decision.

If denied, consider legal appeal before Norwegian courts or Ombudsman.

Once SIS alert is removed – immediately proceed with family reunification application in Croatia.

Optional Assistance:
Would you like:

Final Note
You can monitor SIS entries through data access requests to:

Norwegian Immigration Police: https://www.politiet.no

And also send a data access request to Croatia’s SIS office for confirmation.

Let me know which country/language you prefer lawyer support in (English, Croatian, or Norwegian), and I will assist further.
